Seller Terms & Conditions

1. Reserves Bidding: Sellers may set a reserve price. If no reserve is set, all sales are final.

Sellers are strongly discouraged from bidding on their own items online, as winning requires payment of a 7.5% online buyer’s premium plus the buyback fee. Reserves may not be altered after 6:00PM EST Thursday, March 12, 2026.

2. Title Liens: The seller warrants that all consigned equipment is free of liens or encumbrances. For any titled vehicle, the title must be in hand and signed at check-in, NO EXCEPTIONS, or the item will not be accepted.

3. Loading Unloading: FCFBEF provides loading and unloading as a courtesy and assumes no liability for injury or damage during these services.

4. Payment Seller Proceeds: 

• All items and/or fees must be paid in full by 5:00PM EST Monday, March 16, 2026, regardless of pickup date. 
• Seller payments will be issued approximately two weeks post-sale.
• If FCFBEF does not receive buyer payment, the seller will not be paid, and the item will be considered a No Sale.

5. Refusal: Auctioneer has the right to refuse any consignor or item from the sale.

By consigning equipment, the seller agrees to these terms.

 

Buyer and Seller Terms Conditions

1. Bidder Registration: All bidders must register with a valid ID, name, address, and phone number. Registration constitutes acceptance of these terms.

2. “As-Is, Where-Is” Sales: All items are sold as-is, where-is with no warranties or guarantees, either explicit or implicit. All sales are final. Bidders are responsible for inspecting items before bidding. FCFBEF assumes no responsibility for the condition of any item sold. Any representations made by FCFBEF and Equipmentfacts, as well as their respective employees or agents, are to be considered lay opinions only and neither FCFBEF nor Equipmentfacts shall be liable for any purchase made by a Buyer in reliance upon them, and all such claims arising out of or related thereto are hereby waived and forever released.

3. Item Removal & Storage Fees:

• Items must be removed by 12:00 p.m. EST on Monday, March 16, 2026.
• Items left beyond this deadline will be moved to an offsite location at a cost of $100 per item, plus $25 per item per day for storage.
•  Items unclaimed 30 days post-auction or with accrued storage fees exceeding the hammer price will be disposed of at FCFBEF’s discretion, with no further obligation to the buyer.

4. Payment Terms:

• No items may be removed until paid in full.
• A 7.5% buyer’s premium applies to online purchases.
• Accepted payments: Cash, Credit Card, Wire Transfer, Cashier’s Check, Personal Checks, and Company Checks.
• Out-of-state buyers paying by Company or Personal Check must provide a Bank Letter of Credit guaranteeing the amount. Credit card payments incur a 4% processing fee. Wire transfers: $65 (domestic), $75 (international).

5. Sales Tax: Purchases are subject to Kentucky sales tax unless a valid KY Ag Exemption Number is provided. Resale buyers must submit a Resale Certificate upon purchase.

6. Payment Obligations & Legal Fees:

• Bidders are personally responsible for any bids made with their Bidding Number. If the highest bid for any particular lot is submitted using your Bidding Number, you are responsible and liable for any payments due hereunder, without protest, set-off or claim against FCFBEF or Equipmentfacts LLC (Equipmentfacts).
• The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute FCFBEF and Equipmentfacts shall have absolute discretion either to settle such dispute as they determine or to re-offer the lot for sale.
• Buyers must pay invoices in full. Late payments accrue a $25 per day fee.
• Buyer is responsible for attorney fees, collection costs, and other expenses incurred in collecting overdue payments.
• Any disputes shall be litigated in Fayette County, Kentucky.
• By registering and/or participating in the auction, the bidder agrees to these terms.
